In Dnipro, a young prosecutor has decided to retire after eight years of service.

To achieve this, he requested that a portion of his study period be counted towards his experience.

Prosecutor Dmitry Pasko, who is employed at the Left Bank District Prosecutor's Office in Dnipro, has decided to apply for retirement after eight years of service. In his case, a specific work experience is required to retire, which under normal circumstances amounts to 25 years (for representatives of his profession). This was reported by "Vidomo".

Pasko, having only 8 years and 5 months of experience, sought to justify his request by arguing that his time spent studying at a higher educational institution should also be counted. Dmitry Pasko graduated from the Yaroslav Mudryi National Law University in 2015, where he studied law.

His studies lasted from 2010 to 2015, and he insisted that half of this period should be considered as work experience in the prosecutor's office.

After finishing university, he initially worked in the executive service, and then on January 13, 2017, he was appointed as a prosecutor. Thus, out of his total experience of 8 years, 5 months, and 9 days, the majority of the time—specifically, 7 years, 8 months, and 4 days—was spent in prosecutorial roles.

In addition to the lack of experience, Pasko also pointed out that he has a disability, which under Ukrainian law grants the right to receive a pension with a shorter work history. Specifically, prosecutors with disabilities need only 10 years of experience to retire, while regular prosecutors require 25 years.

In 2017, he was assigned a Group II disability, which was also confirmed by the relevant certificate. Despite all these circumstances, the Pension Fund of Ukraine denied Pasko's pension application, leading him to seek recourse in court.

In his lawsuit, he stated that not only should his work experience be reassessed, but the period of his studies should also be counted as part of his professional experience.

However, the court, while reviewing the case, pointed out that the disability group was established not during his tenure as a prosecutor, which is an important argument in this context. On January 2, 2025, the court rendered a decision on Pasko's case, partially satisfying his claim.

The court noted that the plaintiff is entitled to a portion of the work experience but simultaneously indicated that the total experience is insufficient for retirement.
